    We are in unprecedented times between COVID-19 and the Black Lives Matter movement.  Some rules are more strict, while others are relaxed.  As we navigate this brave new world, we need to make sure that the precautions we are taking are in line with the law, our legal obligations, and our responsibility to provide a discrimination-free workplace, whether the workplace is virtual or physical. 

    Our speaker will show us what are the issues, what’s at stake, and how to address the employer’s needs with diversity and inclusion to run a successful business in a changing world of increasing healthcare infections, financial volatility, employee and customer anxiety, and legal compliance.

    Participants will learn how recent events may:

    • Increase harassment and discrimination against protected groups
    • Impact the process for reasonable accommodation requests
    • Provide some exceptions to standard procedures and legal obligations


    Our speaker:


    Marilynn L. Schuyler, Esq., established Schuyler Affirmative Action Practice in 2010 and has been developing Affirmative Action Plans for public, private, and academic institutions since 1996.  She has been working in the field of Equal Employment Opportunity since 1988.  She provides clients with strategic advice and analysis related to all aspects of Affirmative Action compliance, and produces Affirmative Action Plans consistent with OFCCP regulations.  She has successfully led clients through audits, from notice of audit to notice of compliance, and develops compliant compensation analyses and all other analyses required for responses to OFCCP.  Ms. Schuyler also provides advice and counsel on the Internet Applicant Rule and all related aspects of applicant tracking and recordkeeping.   

    Ms. Schuyler began her professional career at the Department of Labor.  She served in the Oakland District Office of the OFCCP as Assistant District Director, and in the San Francisco Regional Office as an OFCCP Liaison and as the Regional Civil Rights Officer.  In the National Office, she was the Department of Labor's Affirmative Action Officer. She also served as the Affirmative Action Officer for the Office of the President at the University of California, for whom she developed the Affirmative Action Plan for four years.

    Ms. Schuyler received her J.D. from Georgetown University Law Center and her B.A. in Economics from the University of California, Berkeley, where she was an Alumni Scholar.  

    Ms. Schuyler is Chair of Contra Costa County Advisory Council on Equal Employment Opportunity, Board Member of the American Association for Access, Equity, and Diversity (AAAED), former President of the Washington Metro Industry Liaison Group (WMILG), and former Board Member of Wider Opportunities for Women (WOW).

    While the country and our workplaces grapple with COVID-19, employers must still be mindful of required sexual harassment prevention training.  Sexual Harassment and/or Discrimination have not disappeared, but have evolved with current events as well to include more on-line/virtual harassment/discrimination.  In addition, workplaces must re-focus on issues of Diversity and Inclusion in the wake of additional current events. 

    This program will address implicit/unconscious bias, micro-aggressions, and best practices for tackling diversity and inclusion in the workplace.  The program will also cover topics as required by California law for sexual harassment prevention training.  The program will be interactive.  Managers, Supervisors, and Business Owners are encouraged to attend.

    • To satisfy the state mandate, you need to attend live and be prepared to answer and ask questions when called on by the speaker.  Without this connection, we will not be able to mail out your certificate of completion.
    • Although we will be recording the event, watching a recording does not fulfill the requirement since you are not able to interact and ask questions.

    Our speaker:

    James Wu, Esq.

    Since 1996, James Wu has practiced Employment Law in Illinois and California.  He provides day-to-day advice and counsel to Companies regarding HR/employment law compliance and best practices.  James also defends employers in litigation when employment law claims arise in Courts, administrative agencies, and other forums.  Many of the issues James continues to assist employers with include COVID-19 issues, leaves of absence, wage and hour, discrimination/harassment, wrongful termination, employee misclassification, independent contractor classification, and much more.  Simply, James is a trusted advisor and guardian to employers large and small.  James has been recognized (including in 2020) as a "SuperLawyer" in Employment Law in Northern California - a distinction only achieved through peer review and bestowed only to 5% of attorneys in the Northern California.  

    James is located in Walnut Creek, and he is the immediate Past-President of the Contra Costa County Bar Association (served as President in 2018 and 2019), and has been on the Board of Directors for nearly a decade.  James is also a Past-President, and current Board Member, of the Northern California Employment Roundtable which is a group affiliated with the California Department of Fair Employment and Housing (DFEH).

CONTRA COSTA COUNTY EMPLOYER ADVISORY COUNCIL

The CCCEAC is your connection to information about employment and workforce development. The CCCEAC has been in partnership with the State of California Employment Development Department (EDD) since 1980. 

  • Provides to all employers, low-cost, timely seminars on topics such as employment law, workforce development, human resource practices, and professional development. 
  • Works with the EDD to promote regulations, policies, and procedures that are business friendly. 
  • Provides connections between employers, other EACs, and the EDD at the local and state level. 
  • Partners with the Workforce Development Board on hiring talent, and leveraging resources. 
  • Notifies employers about pending legislation that may impact them. 
  • Provides employer representation on state-level panels, boards, and advisory groups.
